江西省重大建设项目稽察办法(省人民政府令第169号) (附:英文译本)

  《江西省重大建设项目稽察办法》已经2008年8月18日省人民政府第8次常务会议讨论通过,现予公布,自2008年10月1日起施行。

   江西省重大建设项目稽察办法

  
  
   第一条 为加强对重大建设项目的监督,保证重大建设项目工程质量和资金安全,提高投资效益,根据国家有关规定,结合本省实际,制定本办法。
   第二条 本办法适用于国家或者省出资、融资,经省发展和改革部门审查批准,以及经省发展和改革部门审核后报省人民政府或者国家发展和改革部门审查批准的重大建设项目。
   本办法所称重大建设项目稽察,是指依照有关法律、法规、规章和本办法的规定,对重大建设项目的建设全过程或者主要环节中与审查批准事项有关的内容进行监督检查的活动。
   第三条 重大建设项目稽察工作,坚持依法办事、客观公正、实事求是的原则。
   第四条 省发展和改革部门负责重大建设项目稽察工作。省重大建设项目稽察特派员办公室(以下简称省稽察办)具体承担重大建设项目稽察工作。
   省稽察办履行下列职责:
   (一)监督检查被稽察单位贯彻执行国家有关法律、法规、规章和方针政策的情况;
   (二)监督检查重大建设项目的招标投标、工程质量、进度等情况;
   (三)监督检查重大建设项目资金使用、概算控制的真实性、合法性;
   (四)对被稽察单位主要负责人的经营管理行为进行评价,提出奖惩建议;
   (五)跟踪监督重大建设项目的整改情况;
   (六)法律、法规和规章规定的其他职责。
   第五条 省稽察办应当根据本省固定资产投资计划和重大建设项目实施情况,于每年3月底前拟定本年度重大建设项目稽察计划,由省发展和改革部门商省财政、审计等有关部门确定后报省人民政府备案。
   第六条 省稽察办应当按照年度重大建设项目稽察计划开展稽察工作。国家发展和改革部门以及省人民政府安排稽察的重大建设项目,省稽察办应当及时组织稽察。
   第七条 省稽察办开展稽察工作,应当根据稽察事项组成稽察组,每个稽察组配备不少于2名稽察人员,稽察人员从省稽察办工作人员中选派。
   省发展和改革部门根据工作需要,可以组织稽察人员与省财政、审计等有关部门人员联合进行稽察,也可以聘请有关专业技术人员参加稽察工作。
   第八条 稽察人员应当具备下列条件:
   (一)熟悉并能贯彻执行有关法律、法规、规章和方针政策;
   (二)坚持原则,廉洁自律,忠实履行职责,保守秘密;
   (三)熟悉项目建设和管理,或者具有财务、审计、工程技术等方面的专业知识,并有相应的综合分析和判断能力。
   第九条 稽察工作实行回避制度。
   省稽察办不得将稽察人员派至其曾经管辖、工作过的重大建设项目或者其近亲属担任被稽察单位高级管理人员的重大建设项目单位从事稽察工作。
   稽察人员与被稽察事项有利害关系的,应当自行回避。
   第十条 省稽察办应当在实施稽察3日前,向被稽察单位送达稽察通知书;必要时,稽察组可以直接持稽察通知书实施稽察。
   第十一条 稽察组实施稽察时,可以采取下列方式:
   (一)听取被稽察单位主要负责人有关重大建设项目的情况汇报,在被稽察单位召开与稽察事项有关的会议,参加被稽察单位与稽察事项有关的会议;
   (二)查阅被稽察单位有关重大建设项目的工程技术资料、财务会计资料以及其他有关资料,必要时,可以要求被稽察单位主要负责人做出说明;
   (三)进入重大建设项目现场进行调查,核实有关情况;
   (四)向参加重大建设项目建设的有关单位、个人了解情况;
   (五)向财政、审计、建设等有关部门了解被稽察单位的重大建设项目资金使用、工程质量情况;
   (六)根据发现的问题,对勘察、设计、施工、监理等相关参建单位进行延伸稽察,核实有关情况。
   根据工作需要,稽察组报告省稽察办同意后,可以委托具有相应资质的中介服务机构提供检验、鉴定等服务。
   第十二条 被稽察单位应当接受稽察组依法进行的稽察,如实向稽察组提供与重大建设项目有关的文件资料,报告建设和管理过程中的重大事项,不得销毁、拒绝、隐匿或者伪造有关文件资料。
   第十三条 省人民政府有关部门和有关设区市、县(市、区)人民政府应当支持、配合稽察组的稽察工作,向稽察组提供被稽察单位有关的情况和资料。
   第十四条 省发展和改革部门应当加强同省财政、审计、监察等有关部门以及金融机构的联系,相互通报有关情况,避免重复检查。
   第十五条 稽察组对稽察工作中发现的问题,应当向被稽察单位核实情况,听取意见。
   稽察组在稽察中发现重大建设项目存在严重工程质量、生态环境、资金安全等问题以及其他紧急情况的,应当及时采取相应措施,并向省稽察办和有关部门专题报告,有关部门应当依法处理。
   第十六条 稽察组应当在稽察工作结束后20日内,提交稽察报告。稽察报告内容主要包括:重大建设项目基本情况、实施情况及分析评价,存在的问题,被稽察单位的意见,处理建议等。
   稽察报告经省稽察办审核后报省发展和改革部门,由省发展和改革部门依据职权作出稽察结论。重大建设项目存在严重问题的,省发展和改革部门应当及时向省人民政府报告。
   第十七条 省发展和改革部门应当采取适当方式向被稽察单位书面反馈稽察结论,并将稽察结论告知省人民政府有关部门、重大建设项目所在地设区市、县(市、区)人民政府。
   被稽察单位对稽察结论有异议的,可以自收到有关书面材料之日起15日内,向省发展和改革部门提出书面复查申请。省发展和改革部门应当自收到复查申请之日起30日内,另行组织人员进行复查,并提出复查意见,通知申请人。被稽察单位对复查意见仍有异议的,可以依法提出申诉。
   第十八条 稽察人员实施稽察时,不得有下列行为:
   (一)泄露国家秘密和被稽察单位的商业秘密;
   (二)接受被稽察单位的任何馈赠、报酬、福利待遇;
   (三)在被稽察单位报销费用;
   (四)参加被稽察单位安排、组织或者支付费用的宴请、娱乐、旅游、出访等活动;
   (五)在被稽察单位为自己、亲友或者他人谋取私利;
   (六)利用职务上便利谋取其他利益。
   第十九条 稽察人员有下列行为之一的,由有关部门依法给予处分;构成犯罪的,依法追究刑事责任:
   (一)对被稽察单位的重大违法违纪问题隐匿不报或者严重失职的;
   (二)与被稽察单位串通编造虚假稽察报告的;
   (三)违反本办法第十八条规定的。
   第二十条 被稽察单位有下列行为之一的,由省发展和改革部门责令限期整改,给予警告或者通报批评;情节严重的,作出冻结、暂停拨付国家和省建设资金,暂停项目建设、或者暂停有关设区市、县(市、区)、有关部门同类新项目审查批准和建设资金安排的处理决定:
   (一)违反项目建设程序,擅自开工建设的;
   (二)未按有关招标投标管理的法律、法规、规章进行招标投标或者逃避、拒绝接受对招标投标活动监督的;
   (三)弄虚作假骗取政府投资、融资的;
   (四)资金使用不符合投资概算内容和有关财务制度规定,挤占、挪用建设项目资金的;
   (五)擅自变更建设规模、建设内容、建设标准和建设地址的;
   (六)违反有关规定,造成工程进度严重滞后的;
   (七)建设项目管理混乱,造成严重后果的;
   (八)其他违反建设项目管理规定的。
   省发展和改革部门作出冻结、暂停拨付国家和省建设资金,或者暂停项目建设资金安排的处理决定,涉及省财政部门职责权限的,应当商省财政部门。
   对被稽察单位的处理,涉及省人民政府有关部门或者设区市、县(市、区)人民政府职责权限的,由省发展和改革部门移交省人民政府有关部门或者设区市、县(市、区)人民政府依法处理。
   重大的处理决定,应当报省人民政府批准。
   第二十一条 省人民政府有关部门和设区市、县(市、区)人民政府对被稽察单位的处理结果,应当抄送(报)省发展和改革部门;省人民政府有关部门或者设区市、县(市、区)人民政府对被稽察单位的违法行为不作处理的,省发展和改革部门可以报请省人民政府责令有关部门或者设区市、县(市、区)人民政府依法作出处理。
   第二十二条 勘察、设计、施工、监理和招标代理机构等单位,在参与重大建设项目建设过程中,有违反法律、法规、规章行为的,由省发展和改革部门或者有关部门按照各自职责依法处理。
   第二十三条 被稽察单位有下列行为之一的,由有关部门对负有责任的主管人员和其他直接责任人员依法给予处分;构成犯罪的,依法追究刑事责任:
   (一)拒绝、阻碍稽察人员依法履行职责的;
   (二)拒绝、故意拖延向稽察人员提供有关情况和资料的;
   (三)销毁、隐匿、伪造有关文件资料的;
   (四)有本办法第二十条所列情形之一的。
   第二十四条 国家或者省出资、融资,经设区市、县(市、区)发展和改革部门审查批准的建设项目,省人民政府及其发展改革部门确定需要稽察的,依照本办法执行。
   第二十五条 本办法自2008年10月1日起施行。

  Administrative Measures of Jiangxi Province for Inspection of Key Construction Projects, adopted at the 8th Executive Meeting of the People’s Government of Jiangxi Province on August 18, 2008, are hereby promulgated and shall go into effect as of October 1, 2008.

  Administrative Measures of Jiangxi Province for Inspection of Key Construction Projects

  Article1
  In order to strengthen the supervision over the key construction projects, ensure their construction quality and funds safety, and increase the investment efficiency, these measures are enacted in accordance with the relevant stipulations of the state and in light of the specific situation of the province.

  Article 2
  These measures apply to the key construction projects supported by the state or provincial investment or finance, and these projects have been examined and approved by the development and reform department of the province, or after being examined by the above department, submitted to and approved by the people’s government of the province or the development and reform department of the state.
  The inspection of key construction projects described in these measures refers to the activities of supervision over and inspection of the examined and approved project contents during the whole process or major phases of the key construction projects in accordance with the relevant laws, rules, regulations and these measures.

  Article 3
  The inspection of key construction projects shall comply with the principle of being law-based, objective, fair, practical and realistic.

  Article 4
  The development and reform department of the province is responsible for the inspection of key construction projects, and the special inspectors’ office of key construction projects of the province (hereinafter referred to as the special inspectors’ office) takes charge of the inspection of the key construction projects.
  The special inspectors’ office shall perform the following duties:
  (1)Supervise and inspect the implementation of the relevant laws, rules, regulations and policies of the state by the inspected units;
  (2)Supervise and inspect the bid invitation and bidding, the construction quality and the progress of key construction projects;
  (3)Supervise and inspect the truthfulness and lawfulness with regard to   fund uses and budgetary estimate control;
  (4)Appraise the operation and management of chief responsible persons of the inspected units, and suggest relevant rewards or punishments;
  (5)Follow up and supervise the required rectification of key construction projects;
  (6)Other duties prescribed by the laws, rules and regulations.

  Article 5
  The special inspectors’ office shall work out the annual inspection plan of key construction projects prior to the end of March every year just in accordance with the plan for investment in fixed assets and implementation of key construction projects of the province, and submit the plan to the people’s government of the province for file after it is approved, on the basis of consultation with the financial, auditing and other relevant departments of the province, by the development and reform department of the province

  Article 6
  The special inspectors’ office shall conduct inspection work in accordance with the annual inspection plan of key construction projects. And with regard to the inspection of key construction project as arranged by the development and reform department of the state and the people’s government of the province, the special inspectors’ office shall organize the inspection without delay.

  Article 7
  The special inspectors’ office shall organize inspection teams according to the specific inspection items, and every team shall have no less than two inspectors who are chosen among the staffs of the special inspectors’ office.
  The development and reform department of the province may, according to the working requirements, organize inspectors to inspect in cooperation with the relevant departments of finance, auditing and so on, and may also invite the relevant professionals to participate in the inspection.

  Article 8
  The inspectors shall meet the following requirements:
  (1)Be well acquainted with and able to fulfill and enforce the relevant laws, rules, regulations and policies;
  (2)Stick to the inspection principles and perform their duties on the basis of being clean, honest, self- disciplined, and secret-keeping ;
  (3)Be well familiarized with the project construction and management, or equipped with sufficient professional knowledge about financial accounting, auditing, engineering technology and so on, as well as adequate ability of overall analysis and judgment.

  Article 9
  The challenge system shall be adopted in the inspection.
  The special inspectors’ office shall not send its inspectors to inspect the key construction projects which they themselves had ever managed or worked for, or where their close relatives are acting as the high-ranking managerial staffs of the inspected units therein.
  A challenge shall be automatically made to the inspectors who have a stake in the inspected matters.

  Article 10
  The special inspectors’ office shall send the inspection notice to the inspected unit three days prior to the inspection. And if necessary, the inspection team may inspect by directly producing the inspection notice.

  Article 11
  The inspection team may adopt the following methods with regard to the inspection:
  (1)Listen to the report on the key construction project given by the chief responsible person of the inspected unit, and convene and attend the meeting relating to the inspection affairs at the inspected unit;
  (2)Review the engineering technical data, financial accounting data and other relevant data concerning the key construction project of the inspected unit, and require the chief responsible person of the inspected unit to explain, if necessary;
  (3)Go to the site of key construction project to investigate and verify the facts concerned;
  (4)Inquire of the related units and individuals involved in the key construction project about relevant issues;
  (5)Inquire of financial, auditing, construction administrative and other relevant departments about the use of funds and the quality of key construction project undertaken by the inspected unit;
  (6)Carry out the extended inspection of the survey, design, construction, supervision and other construction participants, and verify the facts with respect to the problems that have been found.
  Where necessary, the inspection team may, after reporting to and obtaining approval from the special inspectors’ office, entrust qualified intermediary service organizations with the task of testing, appraisal, etc.

  Article 12
  The inspected unit shall accept the legal inspection by the inspection team. The inspected unit shall faithfully provide the inspection team with the documents or materials relating to the key construction project, report the major events in the process of construction and management, and shall not destroy, reject, conceal or fabricate the documents or materials concerned.

  Article 13
  The relevant departments of the people’s government of the province and the relevant people’s governments of the city with districts and county (city or district) shall support and cooperate with the inspection team at the inspection, and supply to the inspection team the information and materials about the inspected unit.

  Article 14
  The development and reform department of the province shall strengthen the mutual contact with the financial, auditing, supervising and other departments of the province as well as the banking institutions, inform each other of the information concerned and avoid repeated inspections.

  Article 15
  Where any problems are found by the inspection team at inspection, the inspection team shall verify the facts at the inspected unit and listen to the opinions thereof.
  Where any serious problems about engineering quality, ecological environment and funds safety, or any other emergencies have been found by the inspection team in the key construction project, the inspection team shall take necessary measures without delay and report specially to the special inspectors’ office and other departments concerned, and the departments concerned shall take relevant actions according to law.

  Article 16
  The inspection team shall submit the inspection report within twenty days upon completion of inspection, in which the basic information about key construction project, its implementation, analysis and evaluation, existing problems, opinions from the inspected unit and suggestions on solution shall be included.
  The inspection report, after being examined by the special inspectors’ office, shall be submitted to the development and reform department of the province, which will in turn come to a conclusion over the inspection within its scope of authority. In case of serious problems existing in the key construction project, the development and reform department of the province shall report immediately to the people’s government of the province.

  Article 17
  The development and reform department of the province shall employ proper means to inform the inspected unit of the inspecting conclusion in written form, and inform the relevant departments of the people’s government of the province and the people’s governments of the city with districts and county (city or district) where the key construction project is located.
  Where the inspected unit disagrees with the conclusion, it may, within fifteen days after receipt of the written information concerned, apply for re-examination to the development and reform department of the province, which shall organize other staffs for re-examination within thirty days after receipt of the application, put forward its opinions on re-examination and inform the applicant. If the inspected unit still disagrees with the opinions upon re-examination, it may lodge an appeal according to the law.

  Article 18
  At the inspection, the inspectors shall not:
  (1)Disclose the state secrets or commercial secrets of the inspected unit;
  (2)Accept any gift, remuneration or benefits from the inspected unit;
  (3)Ask for reimbursement of any expenses in the inspected unit;
  (4)Attend or participate in any banquet, entertainment, tour, visit at abroad and other activities as arranged, organized or financially sponsored by the inspected unit;
  (5)Try to obtain profit for themselves, their relatives, friends or other people;
  (6)Take advantage of their position to seek other personal profits.

  Article 19
  In case of one of the following circumstances on the part of inspectors, the relevant departments shall take disciplinary action according to the law, and if a crime is constituted, they shall be prosecuted for criminal responsibility according to the law.
  (1)To conceal and not to report the serious violation of law and disciplines in the inspected unit or to seriously neglect their duties;
  (2)To collaborate with the inspected unit to fabricate a false inspection report;
  (3)To act in violation of the stipulations in Article 18 of these measures.

  Article 20
  In case of one of the following circumstances on the part of the inspected unit, the development and reform department of the province shall order the inspected unit to stop for rectification, or impose a warning or circulate a notice of criticism, and where it is a serious case, to freeze or suspend the allocation of construction funds by the state and province, suspend the project construction, or suspend the examination and approval of new projects of similar kind in the city with districts, county (city or district) and the departments concerned, and suspend the arrangement of construction funds therefor.
  (1)Violate the procedures for project construction and start to construct without authorization;
  (2)Invite or make a bid not in accordance with the laws, rules and regulations of bid invitation and bidding, and refuse supervision over its bid invitation and bidding;
  (3)Employ trickery to defraud the government of its investment and financing;
  (4)Use the funds not in accordance with the budgetary estimate of investment and stipulations concerned in the financial accounting system, and misappropriate or embezzle the funds for project construction;
  (5)Alter the scale, contents, standard and site of construction without authorization;
  (6)Violate the stipulations concerned and cause the construction progress to lag seriously behind the schedule;
  (7)Cause serious consequences as the result of disordered management of construction;
  (8)Other violations of stipulations for management of construction project.
  Where the decision made by the development and reform department of the province for freezing and suspending the allocation of construction funds by the state and province or suspending the arrangement of construction funds involves the duties or authority of the financial department of the province, it is required that the financial department of the province should be consulted with.
  Where the disposal of the inspected unit involves the duties and authority of the departments concerned in the people’s government of the province or people’s governments of any city with districts and county (city or district), the development and reform department of the province shall hand the case over to the departments concerned in the people’s government of the province or people’s governments of a city with districts and county (city or district) for disposal according to law.
  The major decision on disposal shall be submitted to the people’s government of the province for approval.

  Article 21
  The departments concerned in the people’s government of the province or people’s governments of any city with districts and county (city or district) shall send the copies of (or report) the results from the disposal of the inspected unit to the development and reform department of the province. In case that no disposal is made by the departments concerned in the people’s government of the province or people’s governments of any city with districts and county (city or district) over the illegal acts of the inspected unit, the development and reform department of the province may submit to the people’s government of the province, requesting it to order the departments concerned or people’s governments of the city with districts and county (city or district) to dispose according to the law.

  Article 22
  Any violation of laws, rules and regulations on the part of the surveying, designing, constructing and supervising institutions and tendering agencies, which have participated in the construction of key construction project, shall be disposed of by the development and reform department of the province or the departments concerned within the scope of their duties and according to the law.

  Article 23
  In case of one of the following circumstances on the part of the inspected unit, the departments concerned shall take disciplinary action against the persons in charge who bear the responsibility and other persons bearing direct responsibility according to the law, and if a crime is constituted, they shall be prosecuted for criminal responsibility according to the law.
  (1)Refuse the inspection or prevent inspectors from performing their duties;
  (2)Refuse to provide or deliberately postpone supplying the information and materials concerned to the inspectors;
  (3)Destroy, conceal or falsify the documents and materials concerned;
  (4)One of the circumstances described in Article 20 of these measures.

  Article 24
  Where the construction projects, which are supported by the state or provincial investment and finance and examined and approved by the development and reform departments of the city with districts and county (city or district), are required to be inspected by the people’s government of the province and the development and reform department of the province, the inspection shall be conducted according to these measures.

  Article 25
  These measures shall come into effect as of October 1, 2008.
